Flange Bolt Torque Calculator Terms of Use

1. INTRODUCTION

    1. Flange Bolt Torque Calculator (FBTC): Hynds Pipe Systems Limited (referred to in these Terms of Use as we, us and our) provides access to the FBTC, through our webpage, for the purposes of providing consultants, engineers and contractors with a self-catering tool created for determining bolt and nut torque settings.
    2. Application of Terms of Use: These Terms of Use set out the basis on which we provide, and on which you may access and use, the FBTC. You are deemed to have confirmed your acceptance of these Terms of Use by accessing and using the FBTC. You will not be able to use the FBTC if you do not accept these Terms of Use.
    3. Privacy: To the extent that your use of the FBTC involves the collection and/or use of your personal information, the terms of the FBTC Privacy Policy will apply. You are deemed to have confirmed your acceptance of this privacy policy by accessing and using the FBTC.

2. YOUR USE OF THE FBTC

    1. Your General Responsibilities:
      You acknowledge and agree:

      1. To only use the FBTC:
        1. in accordance with these Terms of Use and for purposes which are permitted by these Terms of Use; and
        2. in accordance with any applicable law, regulation or generally accepted guidelines.
      2. You are responsible for ensuring the completeness and accuracy of all relevant metrics entered into the FBTC, and that calculations can vary as a result of any change to any of such metrics.
      3. To always provide accurate and complete contact information so that we may contact you to discuss and verify the calculations generated by the FBTC.
    2. Prohibited Acts:
      You agree that when using the FBTC you will not:

      1. impersonate another person when using the FBTC or otherwise provide false information when entering your details to access the FBTC.
      2. engage in any activity that interferes with or disrupts the FBTC (or the servers and networks which are connected to the FBTC).
      3. tamper with, hinder the operation of, or make unauthorised modifications of the FBTC; or
      4. knowingly transmit any virus or other disabling feature to or via the FBTC.

3. PERMITTED USE

      1. Permitted Use of the FBTC: The FBTC may only be used as a tool by consultants, engineers and contractors, to obtain indicative torque settings.
      2. Recommendations: Without limiting clause 3.1, you expressly acknowledge and agree:
        1. recommended solutions generated by the FBTC are always subject to verification.

4. DISCLAIMER

      1. Accuracy and Reliability of Inputs: The FBTC relies on the information provided by you and the accuracy of the torque settings generated by the FBTC are contingent upon the accuracy and completeness of the inputs entered by you. We are not responsible for any errors or inaccuracies resulting from user inputs.
      2. User Responsibility: The FBTC is designed to provide indicative torque settings only based on the information provided by you, and any decisions or actions based on the results obtained through the FBTC will be your sole responsibility.
      3. Limitation of Liability: Without limiting the above, to the fullest extent permitted by law, we disclaim all liability for any errors, inaccuracies, or omissions in the FBTC outputs, and for any direct, indirect, incidental, consequential, or special damages that may arise from the use of the FBTC. We make no warranties, express or implied, regarding its operation or results.

5. INTELLECTUAL PROPERTY AND CONTENT

      1. Intellectual Property Rights: We (or our licensors) own all legal right, title and interest in and to the FBTC and outputs generated by the FBTC, including all intellectual property rights which subsist in the FBTC and the outputs generated by the FBTC (whether those rights happen to be registered or not, and wherever in the world those rights exist). You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use such intellectual property only in connection with your use of the FBTC for the permitted purpose recorded above. The FBTC may contain information which is designated confidential by us, and you will not disclose such information without our prior written consent.
      2. No copying etc: You must not copy, distribute, display, or create derivative works based on the FBTC or outputs of the FBTC Tool, in whole or in part, without our prior written consent.
      3. Trademarks: Nothing in these Terms of Use give you any right to use any of our (or our licensor’s) trade names, trademarks, logos, domain names, and/or other distinctive brand features unless we agree in writing.
      4. Update: We may update, amend, or delete any feature or content of the FBTC at any time and for any reason.

6. SUSPENSION AND TERMINATION

      1. Suspension of Operation: We may withdraw or suspend the operation of the FBTC or cease to provide and/or update content to the FBTC, with or without notice to you, if we have reasonable grounds for doing so, including for security, legal or business reasons, or in the event of an emergency.
      2. Suspension or Termination of Access: We may suspend and/or terminate your right to access and use the FBTC, with immediate effect at any time, including where you have not complied with these Terms of Use.

7. AMENDMENTS

      1. Amendments to these Terms of Use: We may from time to time amend these Terms of Use (at our absolute discretion) by providing notice of the amendments on the FBTC. You should check these Terms of Use from time to time to check for any amendments. By continuing to use the FBTC after any such amendment, you are deemed to have agreed to the amended Terms of Use.
